Compensation in this program is tied to the origination work performed, so the responsibilities above are the job, not a formality. Section 8 of RESPA prohibits paying anyone for the referral of settlement service business, and a REMLO arrangement is structured to meet federal and state requirements for mortgage loan originators.

The referral partner relationship exists for exactly that — and it is worth being clear that it is a working relationship, not a compensation arrangement.

You will see programs that hint at getting paid to send your buyers somewhere. Section 8 of the Real Estate Settlement Procedures Act prohibits paying for the referral of settlement service business, and we do not do it.

That is a question for your broker, and it should be asked before you start. Some brokerages permit their agents to originate and some do not, and states differ on whether and how you may act as both the real estate agent and the loan originator on the same transaction, including what has to be disclosed.
